You know that saying, “We’re all unique”?

Well, this saying applies to more than just us as humans. This applies to each person’s passions, career paths and yes, even auto accident cases.

Each auto accident case can take a different amount of time to settle. There is no “one correct amount of time” or “specific time period it should be settled”.

The reason behind this is that each case is different. Unique.

It is completely dependent on what elements go into the case:

  • The severity of what happened
  • Injuries
  • How complex the case is
  • Insurance response time
  • Negotiations
  • Laws
  • Evidence

With each of these things, and more, in mind, your case can either take a few weeks or even a few years.

A big reason behind some cases taking a long time is simply “evidence”.

Gathering and going over evidence takes a very long time, especially if stories of what happened in the auto accident do not align. If one party is telling one version and the other party is telling a completely different version, things can get messy and the lawyers and those involved in the auto accident must sit down and pick apart every detail to get an accurate account.

On top of evidence, the negotiation part of the settlement can take a very long time. If neither party is agreeing on a settlement amount, that tends to make the case take longer to settle.

Now, if both of these elements are easily digested and picked apart, the case may take only a few weeks to settle and you can go about your life with the knowledge that your case is settled and figured out.

Injury Complications and Delays

Another reason cases can take a long time to settle is because of injuries. In some cases, injuries may last longer than expected. Whether that is because you got a large injury or if you have to go back in.

For example: you hurt your neck when you got into your auto accident, and the doctor tells you it should heal in a few weeks on its own.

You go back to the doctor for a checkup and it is worse than it was before and you end up needing surgery.

You go into surgery and believe everything is better but it actually makes things worse, so they have to go in for another surgery.

This is an extreme example, but it is proof that you never know what is going to happen. In this case it could be that the settlement agreed upon was that the party at fault would pay for all medical bills, therefore delaying the settlement of the claim because the medical bills have yet to stop due to the injury being worse.

Every Case is Unique

Each case is different and not the same as another case you may see. So it is important that in the chance that you get into an auto accident, you gather all the evidence you can as well as keep all records of what happened and who was interacted with as well as all the contact information you need.

Otherwise, things can get messy and your auto accident will take much longer to settle.
